Terms of Service

1. Who we are

Molecule.dev is operated by Molecule Dev, Inc., a Delaware corporation ("Molecule", "we", "us"). These Terms of Service are an agreement between you and Molecule Dev, Inc. governing your use of the Molecule.dev website, the application-building platform, the AI development environment, hosting and deployment features, and related services (together, the "Service").

2. Agreement to these terms

By accessing or using the Service, you agree to be bound by these Terms and you confirm that you are responsible for compliance with any applicable local laws. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes it. If you do not agree with these Terms, do not use the Service.

3. Eligibility

You must be at least 13 years old (or 16 where your local law requires a higher minimum) to use the Service. If you are under 18, you may use the Service only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

4. Your account

You are responsible for your account, for keeping your credentials confidential, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

5. Your content and projects

You own the projects, code, and content you create or upload through the Service ("Your Content"). To operate the Service, you grant us a worldwide, non-exclusive license to host, store, copy, run, display, and modify Your Content — solely as needed to provide, secure, and improve the Service — including the right to sublicense those rights to the infrastructure providers we use to run the Service. We may access your private projects where needed for troubleshooting, support you request, security, and abuse prevention. This license is limited to operating the Service: we do not sell Your Content, use it in our marketing without your permission, or share it with third parties for their own purposes.

6. AI-generated output

The Service generates code and content using artificial intelligence ("Output"). As between you and Molecule, and to the extent permitted by applicable law, we assign to you our rights, if any, in the Output generated for your projects. You should know: (a) Output may contain errors, incomplete code, or insecure patterns; (b) because of the nature of AI models, Output may be similar or identical to output generated for other users with similar prompts, and we do not guarantee it is unique or free of third-party rights; and (c) you are responsible for reviewing and testing Output before relying on it or deploying it, especially in commercial, high-stakes, or regulated contexts. Do not treat Output as a source of truth.

7. No AI training on your private content

We do not use your private projects, code, or conversations to train AI models, and we do not permit the third-party AI providers that process your requests to use them for training. We may analyze usage of the Service — including, in aggregated or reviewed form, how conversations with the AI succeed or fail — to operate, secure, and improve the Service itself (for example, improving our prompts, tooling, and reliability).

8. Automated actions

The Service includes an AI agent that can write files, run commands, install dependencies, and take other actions in your project's development environment automatically in response to your instructions. You authorize these actions and accept the risks that come with automatically executed code, including software defects, data loss within your project, and security vulnerabilities in generated code. Review what the agent produces before deploying it.

9. Acceptable use

You may not use the Service to: violate any law or the rights of others; distribute malware or conduct phishing; attempt to gain unauthorized access to any system or data; conduct network attacks or send abusive traffic, whether against the Service or any third party; mine cryptocurrency; artificially consume excessive compute, storage, or bandwidth, or run the same workload across multiple accounts to evade limits; scrape the Service or harvest data from it, including for training machine-learning models; use the Service or Output to build or train a competing AI service; resell the Service without our permission; or misrepresent AI-generated content as human-created where that could cause harm. In addition, do not submit protected health information, payment-card data, or other data subject to specific regulatory protection regimes (such as HIPAA, PCI-DSS, or GLBA) unless we have expressly agreed in writing to handle it; we do not currently offer business associate agreements. We may suspend projects or accounts that violate these rules.

10. Resource limits

Plans include usage limits (such as AI usage, compute, storage, and deployed-app resources) as described where you purchase them. We may enforce quotas and reasonable technical limits to keep the Service reliable for everyone.

11. Third-party services and AI providers

The Service is built on third-party infrastructure and routes AI requests to third-party model providers, depending on the model your project uses. Those providers process your requests to provide the Service and are bound by data-protection obligations, but we do not control their models, and Output is subject to any rights and limitations arising from the underlying models. Each model processes requests in a specific region, shown in the model picker: some models default to providers in the United States, while others — including the default DeepSeek models — default to their native region in China (and some, such as the latest Kimi models, are offered only from China). Requests to a China-region model route that request's prompts and related code to a provider in China. Where a model offers more than one region, you may change it in the picker — the region shown on the model is the one that will process it. Depending on the model and region selected, requests may be processed in the United States or other countries, including outside the European Economic Area. Features that integrate other third-party services (such as payment processors or hosting targets for your apps) are subject to those services' own terms.

12. Your applications and their users

Apps you build and deploy through the Service are yours. You are responsible for them: their content, their compliance with applicable laws, and your relationship with their users — including providing your own terms of service and privacy policy where required. Personal data your app collects from its users is processed by us on your behalf as described in our Data Processing Addendum. We are not a party to the relationship between you and your app's users.

13. Fees

Paid plans and usage-based charges are billed as described at the time of purchase, and subscriptions renew automatically until cancelled. You can cancel at any time in your account settings, effective at the end of the current billing period. AI usage is consumed when a request is processed, even where the resulting Output does not meet your expectations. Except where required by law, fees are non-refundable. If you are a consumer in the EU or UK, you request that we begin providing the paid Service immediately, and you acknowledge that your statutory 14-day right of withdrawal is reduced or lost once performance begins, to the extent permitted by law.

14. Intellectual property

The Service itself — including its software, design, and branding — is owned by Molecule Dev, Inc. and protected by copyright, trademark, and other laws. Open-source components we publish are licensed under their respective licenses (the @molecule packages are licensed under Apache-2.0, and your projects may use them under that license). If you send us feedback or suggestions, you agree we may use them without restriction or compensation.

15. Copyright complaints

We respond to notices of alleged copyright infringement that comply with applicable law (including the DMCA). Send notices to the contact address below, and we may remove infringing content and terminate the accounts of repeat infringers.

16. Beta features

We may offer features identified as beta, preview, or experimental. They are provided as-is, may change or be discontinued at any time, and are excluded from any support commitments.

17. Disclaimer of warranties

The Service and all Output are provided "as is" and "as available". To the fullest extent permitted by law, Molecule and its suppliers and AI providers disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that Output will be accurate, complete, or suitable for your purposes.

18. Limitation of liability

To the fullest extent permitted by law, Molecule and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to your use of (or inability to use) the Service. To the fullest extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of (a) the amounts you paid us for the Service in the twelve months before the claim arose and (b) one hundred US dollars ($100).

19. Indemnification

You agree to defend and indemnify Molecule Dev, Inc. and its officers, directors, employees, and agents against claims arising out of: your violation of these Terms; Your Content; apps you build, deploy, or distribute using the Service (including claims brought by their users); and actions the Service takes on your behalf at your direction. We will notify you of any such claim, and you will not settle one without our consent.

20. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for violation of these Terms, and we may suspend individual projects or deployed apps that violate them. On account deletion, your projects and data are removed as described in our Privacy Policy. Sections that by their nature should survive termination (including Sections 5, 14, 17, 18, 19, and 22) survive.

21. Changes to these terms

We may revise these Terms from time to time. We will post the updated Terms on this page, and material changes will be communicated through the Service before they take effect. By continuing to use the Service after changes take effect, you agree to the revised Terms.

22. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Before filing a claim, you agree to first contact us and attempt in good faith to resolve the dispute informally for at least thirty (30) days. Any dispute arising out of these Terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and each party consents to their jurisdiction. To the extent permitted by law: disputes must be brought on an individual basis, not as a plaintiff or class member in any class, consolidated, or representative proceeding; each party waives its right to a jury trial; and any claim must be filed within one (1) year after it accrues or is permanently barred. Nothing in this section limits rights that consumer-protection law grants you that cannot be waived.

23. Export controls

You may not use the Service in violation of applicable export-control or sanctions laws, and you represent that you are not located in an embargoed jurisdiction or on any restricted-party list.

24. Miscellaneous

These Terms, together with the Privacy Policy and (where applicable) the Data Processing Addendum, are the entire agreement between you and Molecule regarding the Service. If any provision is found unenforceable, the rest remain in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver of it. Neither party is liable for delay or failure to perform (other than payment obligations) caused by events beyond its reasonable control. We may provide notices to you through the Service or to the email address on your account; legal notices to us must be sent to Molecule Dev, Inc. via the contact options on our website.
